Commencement of terms of business

This document constitutes the Terms under which we provide services in setting up and managing insurance for you. We assume you accept the Terms unless you tell us differently. Please read this document carefully. If you have any questions, please reach out.

These Terms replace all proposals and prior discussions and representations, whether oral or written, between us relating to our appointment as your broker in connection with the setting up and managing of your insurance. If we carry out any services after an insurance cancellation, the Terms may need to continue to apply.

Licensing and regulation

SIP International Ltd of DIFC, Gate Building L13, Dubai, UAE  is authorised and regulated by the DFSA under the license number tbd. This can be checked by visiting DFSA’s website https://www.dfsa.ae/public-register/firms or by contacting DFSA on +971(0)4 362 1500.

Appointment and authorization

The Client appoints and authorizes SIP to be the Client’s exclusive insurance intermediary for the Client’s international medical insurance needs. SIP may act on its own or subcontract the provision of services under this Agreement to an agent, in particular but not limited to other group companies that are wholly owned subsidiaries of Swiss Insurance Holding AG, Baar, Switzerland.

SIP is herewith authorized to obtain and negotiate quotations for medical insurance of any kind, instruct, renew, support and cancel medical insurance based on the client’s prior consent or assumed consent (such as in case of emergencies), hold, store and process medical records and personal information including of family members of the Client, obtain information from insurance companies, medical assistance companies, hospitals, clinics, doctors and similar service providers, to carry out their duty as the appointed partner for medical insurance.

Toward insurance companies, the Client remains policyholder with all rights and responsibilities (in particular., receiver of claims payments, debtor of the premium). Likewise, towards medical and other service providers, the Client remains the contractual party with all rights and responsibilities.

Independent intermediary and advisor

SIP is a duly licensed and registered independent insurance intermediary and acting as an independent advisor. SIP has neither product obligations nor exclusive contracts with any particular insurance provider. The Client herewith confirms that SIP has separately informed the Client about the different insurance providers it currently works with and the responsible persons at SIP.

Contract period

This Agreement is entered into for an indefinite period but can be cancelled at any time by either party. The termination of this Agreement for whatever reason shall not affect any accrued rights or liabilities of either party under this Agreement or the coming into force or the continuance in force of any provision of this Agreement which is expressly or by implication intended to come into or continue to be in force on or after termination.

No medical advice or medical services

It is expressly acknowledged and agreed that SIP is not licensed, authorized, or qualified to provide and does not/will never provide any kind of medical advice or medical services. SIP has no obligations or liabilities under this Agreement in respect of any such matters.

Remuneration

The advice, support and management of medical insurance is remunerated on the basis of a commission which is paid by the insurance providers, under a commission agreement between SIP and the insurance providers. Such commission ranges from 10% to 20% of the insurance premiums or of the service provider fees in any given year, and up to 25% on first year insurance premiums. The Client herewith agrees with such commission payment-based remuneration of SIP.

Warranties and undertakings by the client

The Client shall not make any false, incomplete, or misleading statements to SIP and shall immediately and without delay notify SIP of any inaccuracies, problems or issues which are or may be relevant to SIP. The Client specifically warrants that neither the Client nor any family member has any serious health problems, of which the Client has not informed SIP. In the event that any information supplied to SIP regarding the particulars or situation of the Client, or any family member changes during the term of this Agreement, the Client shall immediately and without delay inform SIP of such change. The Client shall indemnify SIP (for itself, its directors, officers, and employees, as well as any and all agents or representatives engaged by SIP) against any and all losses, damages, costs, expenses, debts, obligations, liabilities, claims, demands and actions suffered or incurred by any of them arising directly or indirectly out of or in connection with this Agreement, the services provided, or the termination of this Agreement. This indemnity shall however not apply if and to the extent that any such losses, damages, costs, expenses, debts, obligations, liabilities, claims, demands and/ or actions are caused by willful default, bad faith, or gross negligence on the part of SIP or the relevant directors, officers, or employees. The Client acknowledges that he/she has had the opportunity to consider and obtain independent legal advice prior to entering into this Agreement and has not relied on any express or implied representation, written or oral, of SIP or any other party as an inducement to enter into this Agreement.

Liability and liability insurance

SIP does not exclude its liability arising from its gross negligence or willful default. Any other liability of SIP is however excluded to the fullest extent permitted by law. SIP will therefore, in particular, not be liable for any act, omission or failure of any SIP directors, officers or employees; any agent or representative of SIP; any Government Authority, Parliament, Court or other sovereign, executive or judiciary body of any country, or any international or supranational organization; any insurance company, medical professional, hospital or other service provider which SIP may introduce the Client and/ or any family member; and/or any other third party. SIP shall not be liable for any delay, interruption or failure in performing its services. SIP has a professional liability insurance policy covering up to USD tbd for asset damage and USD tbd for personal injury and property damage. This is also the maximum amount of liability of SIP which the Client herewith agrees to, and only to the extent that this is covered by the said insurance policy.

Privacy policy

The terms and conditions below outline the rules and regulations for online and offline activities with SIP. The terminology “SIP” refers to all companies that form part of the SIP group of companies, operating under the trade name/brand SIP Medical Family Office, which is an internationally registered trademark. Companies include SIP Medical Family Office AG, SIP Switzerland AG, SIP Europe AG, SIP MFO Ltd.

By using our website www.sip.ch or collaborating with SIP through any other channel such as telephone, email, or similar, you hereby consent to our Privacy Policy and agree to its terms. By working with us, we assume you accept these terms and conditions. SIP shall treat as confidential all information received nd shall not use or disclose any such information without the prior written consent, unless such information is being used or disclosed in the context of the services explicitly requested and provided (see abstract “How we use your information”). Equally, you treat as confidential all information relating to SIP, its know-how and procedures, and any documents relating to our operations and which is not in the public domain.

License

Unless otherwise stated, SIP  and/or its licensors own the intellectual property rights for all material on www.sip.ch. All intellectual property rights are reserved. You may access this from www.sip.ch for your own personal use subject to restrictions set in these terms and conditions.

You must not:

• Republish material from SIP
• Sell, rent or sub-license material from SIP
• Reproduce, duplicate or copy material from SIP
• Redistribute content from SIP

Log files

SIP follows a standard procedure of using log files. These files log visitors when they visit websites and certain social media. All hosting companies do this and a part of hosting services’ analytics. The information collected by log files include internet protocol (IP) addresses, browser type, Internet Service Provider (ISP), date and time stamp, referring/exit pages, and possibly the number of clicks. These are not linked to any information that is personally identifiable. The purpose of the information is for analyzing trends, administering the site, tracking users’ movement on the website, and gathering demographic information.

Cookies

Like any other website, SIP uses ‘cookies’. These cookies are used to store information including visitors’ preferences, and the pages on the website that the visitor accessed or visited. The information is used to optimize the users’ experience by customizing our web page content based on visitors’ browser type and/or other information. We will consider requests to remove links but we are not obligated to or so or to respond to you directly. Information we collect

The personal information that you are asked to provide, and the reasons why you are asked to provide it, will be made clear to you at the point we ask you to provide your personal information. If you contact us through a website or social media contact form, we may receive additional information about you such as your name, date of birth, nationality, residence, email address, home address, phone number, job title, preferred correspondance language, the contents of the message and/or attachments you may send us, and any other information you may choose to provide. If you are a prospect or client of us, we may collect further information for the fulfillment of our services. 

Our online forms and internal systems are regularly audited to ensure privacy by design. No information shall be collected that is not required for the fulfillment of our service. How we use your informtion is outlined in further detail in the following abstract.

How we use your information / Processing of personal data

SIP may collect, store, use and otherwise process Personal Data, including health data, as necessary for the following purposes based on the following legal grounds: (1) to provide its advisory services, for example to generate quotations and comparisions of insurance products, or to administer the insurance policy, for example to process any claims and requests for pre-authorizations from the insurance company, or to provide medical professionals, hospitals or other service providers with the health records based on a your consent; (2) to comply with obligations under applicable law, based on applicable law and SIP’s legitimate interest in ensuring compliance; (3) based on its legitimate interest for the establishment, exercise or defense of legal claims. (4) In addition, SIP may process Personal Data (but excluding health data) to inform the Client from time to time about activities, offers, or information that SIP believes would be useful to the Client. Objections to the processing of Personal Data for marketing purposes can be sent to the Data Protection Officer at dpo@sip.ch. Personal Data will be stored by SIP for as long as is necessary to provide the services and comply with legal requirements such as record retention obligations.

SIP may share Personal Data as follows: (1) with service providers such as IT providers; (2) with third parties, o the extent necessary for the purpose of the above, such as insurance providers, hospitals and medical professionals, and with courts and authorities. SIP will not share Personal Data for marketing purposes with any third parties without first asking for the Client’s explicit consent. Personal Data may be transferred outside abroad. If the recipient is located in a country without an adequate level of protection, the transfer will be based on safeguards such as the EU Model Clauses (a copy can be obtained from SIP’s Data Protection Officer). Within the limits of applicable data protection law, the Client has the right to (1) request from SIP access to and rectification or erasure of Personal Data or restriction of processing, (2) object to the processing, (3) request a copy of Personal Data in a portable format or have Personal Data transferred to another controller, (4) withdraw consent, without affecting the lawfulness of processing based on consent before its withdrawal; and (5) lodge a complaint with a supervisory authority (in Switzerland, with the Federal Data Protection and Information Commissioner). The Client can advise SIP at any time to limit or cancel the sharing of data by SIP with specific service providers.

You expressly agrees not to share health data relating to  family members without having obtained their explicit, informed consent for SIP to process their health data.

Further to that, we may use the information to:

• Provide, operate, and maintain our website and social media channels
• Improve, personalize, and expand our website and social media channels
• Understand and analyze how you use our website and social media channels
• Develop new products, services, features, and functionality
• Communicate with you, to provide you with updates and other information relating to our core business activities
• Send you emails
• Find and prevent fraud

GDPR data protection rights

We would like to make sure you are fully aware of all of your data protection rights. Every user is entitled to the following:

• The right to access – You have the right to request copies of your personal data. We may charge you a small fee for this service.
• The right to rectification – You have the right to request that we correct any information you believe is inaccurate. You also have the right to request that we complete the information you believe is incomplete.
• The right to erasure – You have the right to request that we erase your personal data, under certain conditions.
• The right to restrict processing – You have the right to request that we restrict the processing of your personal data, under certain conditions.
• The right to object to processing – You have the right to object to our processing of your personal data, under certain conditions.
• The right to data portability – You have the right to request that we transfer the data that we have collected to another organization, or directly to you, under certain conditions.
• If you make a request, we have one month to respond to you. If you would like to exercise any of these rights, please contact us.

Severability and assignment

Should one of the provisions of this contract be invalid, void or unenforceable, this shall not affect the validity or enforceability of the remaining provisions. SIP shall be entitled to assign any of its rights and/or obligations under this Agreement at any time to any third party.

Applicable law and jurisdiction

This Agreement shall in all respects be governed by and construed in accordance with the substantive laws of the UAE (with the exclusion of conflict of law rules), and exclusive place of jurisdiction, for all disputes arising out of or in connection with this Agreement (including any dispute regarding the existence, validity, or termination thereof), shall be Dubai, UAE.

Inkrafttreten der Geschäftsbedingungen

Dieses Dokument stellt die Bedingungen dar, unter denen wir unsere Dienstleistungen bei der Einrichtung und Verwaltung von Versicherungen für Sie erbringen. Wir gehen davon aus, dass Sie die Bedingungen akzeptieren, es sei denn, Sie teilen uns etwas anderes mit. Bitte lesen Sie dieses Dokument sorgfältig durch. Wenn Sie Fragen haben, wenden Sie sich bitte an uns.

Diese Bedingungen ersetzen alle Vorschläge und früheren mündlichen oder schriftlichen Diskussionen und Zusicherungen zwischen uns in Bezug auf unsere Ernennung als Ihr Broker in Verbindung mit der Einrichtung und Verwaltung Ihrer Versicherung. Wenn wir nach einer Versicherungskündigung weitere Dienstleistungen erbringen, müssen die Bedingungen möglicherweise weiterhin gelten.

Lizenzierung und Regulierung

SIP International Ltd of DIFC, Gate Building L13, Dubai, UAE ist von der FINMA unter der Zulassungsnummer tbd zugelassen und reguliert. Diese kann auf der Website der DFSA https://www.dfsa.ae/public-register/firms eingesehen oder unter der Telefonnummer +971 (0)4 362 1500 erfragt werden.

Bevollmächtigung

Der Kunde ernennt und bevollmächtigt SIP als exklusiven Versicherungsvermittler für den internationalen Krankenversicherungsbedarf des Kunden. SIP kann selbst tätig werden oder die Erbringung von Dienstleistungen im Rahmen dieses Vertrages an einen Vermittler untervergeben, insbesondere, aber nicht ausschließlich, an andere Konzerngesellschaften, die100%igeTochtergesellschaften der Swiss Insurance Holding AG, Zug, Schweiz, sind.

SIP wird hiermit bevollmächtigt, Angebote für Krankenversicherungen jeglicher Art einzuholen und zu verhandeln, Krankenversicherungen beauftragen, zu erneuern, zu betreuen und zu stornieren, basierend auf der vorherigen Zustimmung oder der angenommenen Zustimmung des Kunden (wie z.B. in Notfällen), medizinische Unterlagen und persönliche Informationen auch von Familienmitgliedern des Kunden, aufzubewahren, zu speichern und zu verarbeiten, Informationen von Versicherungsgesellschaften, medizinischen Hilfsunternehmen, Krankenhäusern, Kliniken, Ärzten und ähnlichen Dienstleisterneinzuholen, um ihre Aufgabe als beauftragter Partner für Krankenversicherungen zu erfüllen.

Gegenüber den Versicherungsgesellschaften bleibt der Kunde Versicherungsnehmer mit allen Rechten und Pflichten (insbesondere, Empfänger von Schadenzahlungen, Schuldner der Prämie). Auch gegenüber medizinischen und sonstigen Dienstleistern bleibt der Kunde Vertragspartner mit allen Rechten und Pflichten.

Unabhängiger Vermittler und Berater

SIP ist ein ordnungsgemäss zugelassener und registrierter unabhängiger Versicherungsvermittler und handelt als unabhängiger Berater. SIP hat weder Produktverpflichtungen noch Exklusivverträge mit einem bestimmten Versicherungsanbieter. Der Kunde bestätigt hiermit, dass SIP den Kundengesondert über die verschiedenen Versicherungsanbieter, mit denen sie derzeit zusammenarbeitet, und die zuständigen Personen bei SIP informiert hat.

Vertragsdauer

Dieser Vertrag wird auf unbestimmte Zeitgeschlossen, kann aber jederzeit von beiden Parteien gekündigt werden. Die Beendigung dieses Vertrages, aus welchem Grund auch immer, hat keinen Einfluss auf die entstandenen Rechte oder Verbindlichkeiten einer der beiden Parteien aus diesem Vertrag oder auf das Inkrafttreten oder den Fortbestand von Bestimmungen dieses Vertrages, die ausdrücklich oder stillschweigend dazu bestimmt sind, bei oder nach der Beendigung in Kraft zu treten oder weiter in Kraft zu bleiben.

Keine medizinische Beratung oder Dienstleistungen

Es wird ausdrücklich anerkannt und vereinbart, dass SIP nicht lizenziert, autorisiert oder qualifiziert ist, um irgendeine Art von medizinischer Beratung oder medizinischen Dienstleistungen zu erbringen und dies auch nicht tun wird. SIP hat im Rahmen dieser Vereinbarung keine Verpflichtungen oder Haftungen in Bezug auf solche Angelegenheiten.

Vergütung

Die Beratung, Betreuung und Verwaltung von Krankenversicherungen wird auf der Grundlage einer Provision vergütet, die von den Versicherungsanbietern gemäss einer Provisionsvereinbarung zwischen SIP und den Versicherungsanbietern gezahlt wird. Diese Provision beträgt zwischen 10 % und 20 % der Versicherungsprämien im jeweiligen Jahr und in bestimmten Fällen bis zu 25 % auf die Versicherungsprämien des ersten Jahres. Der Kunde erklärt sich hiermit mit einer solchen provisionsabhängigen Vergütung von SIP einverstanden.

Garantien und Zusicherungen des Kunden

Der Kunde verpflichtet sich, keine falschen, unvollständigen oder irreführenden Angaben gegenüber SIP zu machen und SIP unverzüglich und ohne Verzögerung über alle Ungenauigkeiten, Probleme oder Fragen zu informieren, die für SIP relevant sind oder sein könnten. Der Kunde garantiert ausdrücklich, dass weder der Kunde noch ein Familienmitglied ernsthafte gesundheitliche Probleme hat, über die der Kunde SIP nicht informiert hat. Sollten sich während der Laufzeit dieses Vertrages die SIP zur Verfügung gestellten Informationen über die Angaben oder die Situation des Kunden oder eines Familienmitglieds ändern, muss der Kunde SIP unverzüglich und ohne Verzögerung über diese Änderung informieren. Der Kunde stellt SIP (für sich selbst, seine Direktoren, leitenden Angestellten und Mitarbeiter sowie alle von SIP beauftragten Agenten oder Vertreter) von allen Verlusten, Schäden, Kosten, Ausgaben, Schulden, Verpflichtungen, Verbindlichkeiten, Ansprüchen, Forderungen und Klagen frei, die direkt oder indirekt aus oder in Verbindung mit diesem Vertrag, den erbrachten Dienstleistungen oder der Beendigung dieses Vertrags entstehen. Diese Entschädigung gilt jedoch nicht, wenn und soweit solche Verluste, Schäden, Kosten, Ausgaben, Schulden, Verpflichtungen, Verbindlichkeiten, Ansprüche, Forderungen und/oder Klagen durch vorsätzliche Nichterfüllung, Böswilligkeit oder grobe Fahrlässigkeit seitens SIP oder der entsprechenden Direktoren, leitenden Angestellten oder Mitarbeiter verursacht werden. Der Kunde erkennt an, dass er die Möglichkeit hatte, eine unabhängige Rechtsberatung zu erwägen und zu erhalten, bevor er diesen Vertrag abschließt, und dass er sich nicht auf eine ausdrückliche oder stillschweigende Zusicherung, schriftlich oder mündlich, von SIP oder einer anderen Partei als Anreiz zum Abschluss dieses Vertrags verlassen hat.

Haftung und Haftpflichtversicherung

SIP schließt seine Haftung aus grober Fahrlässigkeit odervorsätzlichem Verschulden nicht aus. Jede andere Haftung von SIP ist jedoch im vollen gesetzlich zulässigen Umfang ausgeschlossen. SIP haftet daher insbesondere nicht für Handlungen, Unterlassungen oder Versäumnisse von SIP-Direktoren, -Führungskräften oder -Mitarbeitern; von Agenten oder Vertretern von SIP; von Regierungsbehörden, Parlamenten, Gerichten oder anderen hoheitlichen, exekutiven oder richterlichen Organen eines Landes oder von internationalen oder supranationalen Organisationen; von Versicherungsgesellschaften, Ärzten, Krankenhäusern oder anderen Dienstleistern, die SIP dem Kunden und/oder Familienmitgliedern vorstellt; und/oder von anderen Dritten. SIP haftet nicht für Verzögerungen, Unterbrechungen oder Versäumnisse bei der Erbringung seiner Dienstleistungen. SIP hat eine Berufshaftpflichtversicherung mit einer Deckungssumme von bis zu USD tbd für Vermögensschäden und USD tbd für Personen- und Sachschäden. Dies ist auch die maximale Haftungssumme von SIP, mit der sich der Kunde hiermit einverstanden erklärt, und zwar nur in dem Umfang, der durch die genannte Versicherung abgedeckt ist.

Datenschutz

Die nachstehenden Bedingungen beschreiben die Regeln und Vorschriften für Online- und Offline-Aktivitäten mit SIP. Der Begriff “SIP” bezieht sich auf alle Unternehmen, die zur SIP-Unternehmensgruppe gehören und unter dem international eingetragenen Markennamen SIP Medical Family Office tätig sind. Zu den Unternehmen gehören die SIP Medical Family Office AG, die SIP Switzerland AG, die SIP Europe AG, die SIP MFO Ltd.

Durch die Nutzung unserer Website www.sip.ch oder die Zusammenarbeit mit SIP über einen anderen Kanal wie Telefon, E-Mail oder ähnliches erklären Sie sich mit unserer Datenschutzrichtlinie einverstanden und stimmen deren Bedingungen zu. Wenn Sie mit uns zusammenarbeiten, gehen wir davon aus, dass Sie diese Bedingungen akzeptieren. SIP behandelt alle erhaltenen Informationen vertraulich und wird diese nicht ohne vorherige schriftliche Zustimmung verwenden oder offenlegen, es sei denn, diese Informationen werden im Rahmen der ausdrücklich angeforderten und erbrachten Dienstleistungen verwendet oder offengelegt (siehe Zusammenfassung “Wie wir Ihre Informationen verwenden”). Ebenso behandeln Sie alle Informationen, die sich auf SIP, sein Know-how und seine Verfahren beziehen, sowie alle Dokumente, die sich auf unsere Tätigkeit beziehen und nicht öffentlich zugänglich sind, als vertraulich.

Lizenz

Sofern nicht anders angegeben, besitzen SIP und/oder seine Lizenzgeber die geistigen Eigentumsrechte für das gesamte Material auf www.sip.ch. Alle geistigen Eigentumsrechte sind vorbehalten. Sie können auf www.sip.ch für Ihren persönlichen Gebrauch zugreifen, vorbehaltlich der in diesen Bedingungen und Konditionen festgelegten Einschränkungen.

Sie dürfen nicht:

• Material von SIP neu zu veröffentlichen
• Material von SIP verkaufen, vermieten oder unterlizenzieren
• Material von SIP zu reproduzieren, zu duplizieren oder zu kopieren
• Inhalte von SIP weiterverteilen

Log-Dateien

SIP verwendet standardmässig Protokolldateien. Diese Dateien protokollieren die Besuche von Besuchern auf Websites und gewissen Sozialen Medien. Alle Hosting-Unternehmen tun dies und es ist Teil der Analyse der Hosting-Dienste. Zu den in den Protokolldateien gesammelten Informationen gehören Internetprotokolladressen (IP), Browsertyp, Internetdienstanbieter (ISP), Datums- und Zeitstempel, verweisende und verlassende Seiten und möglicherweise die Anzahl der Klicks. Diese Daten werden nicht mit Informationen verknüpft, die eine persönliche Identifizierung ermöglichen. Der Zweck dieser Informationen ist die Analyse von Trends, die Verwaltung der Website, die Verfolgung der Bewegungen der Nutzer auf der Website und die Erfassung demografischer Informationen.

Wie wir Ihre Informationen verwenden / Verarbeitung von personenbezogenen Daten

SIP kann personenbezogene Daten, einschließlich Gesundheitsdaten, erheben, speichern, verwenden und anderweitig verarbeiten, soweit dies für die folgenden Zwecke auf der Grundlage der folgenden Rechtsgrundlagen erforderlich ist: (1) zur Erbringung von Beratungsleistungen, z. B. zur Erstellung von Angeboten und Vergleichen von Versicherungsprodukten, oder zur Verwaltung des Versicherungsvertrags, z. B. zur Bearbeitung von Ansprüchen und Anträgen auf Vorabgenehmigungen bei der Versicherungsgesellschaft, oder zur Bereitstellung von Gesundheitsdaten an Ärzte, Krankenhäuser oder andere Dienstleister auf der Grundlage Ihrer Einwilligung; (2) zur Erfüllung von Verpflichtungen nach geltendem Recht auf der Grundlage des geltenden Rechts und des berechtigten Interesses von SIP an der Sicherstellung der Einhaltung; (3) auf der Grundlage des berechtigten Interesses an der Begründung, Ausübung oder Verteidigung von Rechtsansprüchen. (4) Darüber hinaus kann SIP personenbezogene Daten (mit Ausnahme von Gesundheitsdaten) verarbeiten, um den Kunden von Zeit zu Zeit über Aktivitäten, Angebote oder Informationen zu informieren, von denen SIP glaubt, dass sie für den Kunden nützlich sind. Einwände gegen die Verarbeitung personenbezogener Daten zu Marketingzwecken können an den Datenschutzbeauftragten unter dpo@sip.ch gesendet werden. Personenbezogene Daten werden von SIP so lange gespeichert, wie es für die Erbringung der Dienstleistungen und die Einhaltung gesetzlicher Vorschriften, wie z. B. Aufbewahrungspflichten, erforderlich ist.

SIP kann personenbezogene Daten wie folgt weitergeben: (1) mit Dienstleistern wie IT-Anbietern; (2) mit Dritten, soweit dies für die oben genannten Zwecke erforderlich ist, wie z. B. mit Versicherungsanbietern, Krankenhäusern und Ärzten, sowie mit Gerichten und Behörden. SIP gibt keine persönlichen Daten zu Marketingzwecken an Dritte weiter, ohne vorher die ausdrückliche Zustimmung des Kunden einzuholen. Personenbezogene Daten können ins Ausland übermittelt werden. Befindet sich der Empfänger in einem Land ohne angemessenes Schutzniveau, erfolgt die Übermittlung auf der Grundlage von Garantien wie den EU-Musterklauseln (eine Kopie kann beim Datenschutzbeauftragten von SIP angefordert werden). Im Rahmen des geltenden Datenschutzrechts hat der Kunde das Recht, (1) von SIP Zugang zu personenbezogenen Daten und deren Berichtigung oder Löschung oder die Einschränkung der Verarbeitung zu verlangen, (2) der Verarbeitung zu widersprechen, (3) eine Kopie der personenbezogenen Daten in einem tragbaren Format anzufordern oder personenbezogene Daten an einen anderen für die Verarbeitung Verantwortlichen übermitteln zu lassen, (4) die Einwilligung zu widerrufen, ohne dass die Rechtmäßigkeit der Verarbeitung aufgrund der Einwilligung vor deren Widerruf berührt wird, und (5) eine Beschwerde bei einer Aufsichtsbehörde (in der Schweiz beim Eidgenössischen Datenschutz- und Öffentlichkeitsbeauftragten) einzureichen. Der Kunde kann SIP jederzeit mitteilen, dass er die gemeinsame Nutzung von Daten durch SIP mit bestimmten Dienstleistern einschränken oder aufheben möchte.

Sie erklären sich ausdrücklich damit einverstanden, keine Gesundheitsdaten von Familienmitgliedern weiterzugeben, ohne deren ausdrückliche und informierte Zustimmung zur Verarbeitung ihrer Gesundheitsdaten durch SIP eingeholt zu haben.

Entrée en vigueur des conditions générales

Nous partons du principe que vous avez accepté ces conditions, sauf avis contraire de votre part. Veuillez lire attentivement ce document. Si vous avez des questions, n’hésitez pas à nous contacter.

Les présentes conditions remplacent toutes les propositions, discussions et déclarations antérieures, qu’elles soient orales ou écrites, entre nous concernant notre désignation en tant que courtier pour l’établissement et la gestion de votre assurance. Si nous fournissons des services après l’annulation d’une assurance, il se peut que les conditions continuent à s’appliquer.

Licence et réglementation

SIP International Ltd, DIFC, Gate Building L13, Dubai, UAE est autorisée et réglementée par la DFSA sous le numéro de licence tbd. Cette autorisation peut être vérifiée en consultant le site Internet de la DFSA https://www.dfsa.ae/public-register/firms ou en contactant la DFSA au +971 (0)4 362 1500.

Nomination et autorisation

Le client nomme et autorise SIP à être le partenaire du client pour l’intermédiaire d’assurance exclusif pour ses besoins d’assurance santé internationale. SIP peut agir seul ou sous-traiter les services en vertu du présent contrat à un agent, en particulier, mais sans s’y limiter, à d’autres sociétés du groupe qui sont des filiales à part entière de Swiss Insurance Holding AG, Baar, Suisse.

SIP est autorisé à obtenir et à négocier des devis pour des assurances médicales de toute nature, à donner des instructions, à renouveler, à soutenir et à annuler des assurances médicales sur la base du consentement préalable du client ou d’un consentement présumé (comme en cas d’urgence), à détenir, à stocker et à traiter des dossiers médicaux et des informations personnelles, y compris celles des membres de la famille du client, à obtenir des informations auprès de compagnies d’assurance, de sociétés d’assistance médicale, d’hôpitaux, de cliniques, de médecins et de prestataires de services similaires, afin de remplir sa mission en tant que partenaire désigné pour les assurances santé.

À l’égard des compagnies d’assurance, le client reste le titulaire de la police avec tous les droits et responsabilités (c’est-à-dire le destinataire des indemnités, le débiteur de la prime). De même, vis-à-vis des prestataires de services médicaux et autres, le client reste la partie contractante avec tous les droits et responsabilités.

Intermédiaire et conseiller indépendant

SIP est un intermédiaire d’assurance indépendant dûment autorisé et enregistré et agit en tant que conseiller indépendant. SIP n’a pas d’obligation de produit ni de contrat exclusif avec un fournisseur d’assurance particulier. Le client confirme par la présente que SIP l’a informé séparément des différents assureurs avec lesquels il travaille actuellement et des personnes responsables chez SIP. moment par l’une ou l’autre des parties. La résiliation du présent contrat, quelle qu’en soit la raison, n’affecte pas les droits et obligations acquis par l’une ou l’autre des parties en vertu du présent contrat, ni l’entrée en vigueur ou le maintien en vigueur de toutedisposition du présent contrat qui est expressément ou implicitement destinée à entrer en vigueur ou à rester en vigueur au moment de la résiliation ou après celle-ci.

Durée du contrat

Le présent contrat est conclu pour une durée indéterminée, mais peut être résilié à tout moment par l’une ou l’autre des parties. La résiliation du présent Contrat, pour quelque raison que ce soit, n’affectera pas les droits ou obligations nés de ce Contrat pour l’une ou l’autre des Parties, ni l’entrée en vigueur ou le maintien de toute disposition du présent Contrat qui serait expressément ou implicitement destinée à entrer en vigueur ou à rester en vigueur lors ou après la résiliation.

Pas de conseil ou de service médical

Il est expressément reconnu et convenu que SIP n’est pas autorisé, habilité ou qualifié pour fournir et ne fournit pas/ne fournira jamais de conseils médicaux ou de services médicaux. SIP n’a aucune obligation ou responsabilité en vertu du présent contrat en ce qui concerne ces questions.

Rémunération

Le conseil, l’assistance et la gestion de l’assurance santé sont rémunérés sur la base d’une commission qui est payée par les fournisseurs d’assurance, en vertu d’un accord de commission entre SIP et les fournisseurs d’assurance. Cette commission est comprise entre 10% et 20% des primes d’assurance pour une année donnée, et jusqu’à 25% sur les primes d’assurance de la première année. Le client accepte par la présente la rémunération de SIP basée sur le paiement de commissions.

Garanties et engagements du client

Le client s’engage à ne pas faire de déclarations fausses, incomplètes ou trompeuses à SIP et à notifier immédiatement et sans délai à SIP toute inexactitude, tout problème ou toute question qui concerne ou pourrait concerner SIP. Le client garantit spécifiquement que ni le client ni aucun membre de sa famille n’a de problèmes de santé graves, dont le client n’a pas informé SIP. En cas de modification des informations fournies à SIP concernant les caractéristiques ou la situation du client ou d’un membre de sa famille pendant la durée du présent contrat, le client en informera immédiatement et sans délai SIP. Le client garantit SIP (pour lui-même, ses administrateurs, ses dirigeants et ses employés, ainsi que pour tous les agents ou représentants engagés par SIP) contre toute perte, tout dommage, tout coût, toute dépense, toute dette, toute obligation, toute responsabilité, toute réclamation, toute demande et toute action subie ou encourue par l’un d’entre eux et découlant directement ou indirectement du présent contrat, des services fournis ou de la résiliation du présent contrat. Cette indemnisation ne s’applique toutefois pas si et dans la mesure où ces pertes, dommages, coûts, dépenses, dettes, obligations, responsabilités, réclamations, demandes et/ou actions sont causées par un manquement délibéré, une mauvaise foi ou une négligence grave de la part de SIP ou des administrateurs, dirigeants ou employés concernés. Le client reconnaît qu’il a eu l’occasion d’examiner et d’obtenir un avis juridique indépendant avant de conclure le présent contrat et qu’il ne s’est pas fondé sur une représentation expresse ou implicite, écrite ou orale, de SIP ou de toute autre partie pour l’inciter à conclure le présent contrat.

Responsabilité et assurance responsabilité

SIP n’exclut pas sa responsabilité découlant d’une négligence grave ou d’une faute intentionnelle. Toute autre responsabilité de SIP est cependant exclue dans toute la mesure permise par la loi. Ainsi, SIP ne sera notamment pas responsable de tout acte, omission ou manquement des administrateurs, dirigeants ou employés de SIP ; de tout agent ou représentant de SIP ; de toute autorité gouvernementale, parlement, tribunal ou autre organe souverain, exécutif ou judiciaire de tout pays, ou de toute organisation internationale ou supranationale ; de toute compagnie d’assurance, de tout professionnel de la santé, de tout hôpital ou de tout autre prestataire de services que SIP pourrait présenter au client et/ou à tout membre de sa famille ; et/ou de tout autre tiers. SIP ne peut être tenu responsable de tout retard, interruption ou défaut d’exécution de ses services. SIP dispose d’une assurance responsabilité civile professionnelle couvrant jusqu’à CHF 2’000’000 pour les dommages aux biens et CHF 5’000’000 pour les dommages corporels et matériels. C’est également le montant maximal de la responsabilité de SIP que le client accepte par la présente, et uniquement dans la mesure où celle-ci est couverte par ladite police d’assurance.

Droits à la protection des données dans le cadre du GDPR

Nous souhaitons nous assurer que vous êtes pleinement conscient de vos droits en matière de protection des données. Chaque utilisateur a les droits suivants :

• Droit d’accès – Vous avez le droit de demander des copies de vos données personnelles. Il se peut que nous vous facturions une somme modique pour ce service.
• Droit de rectification – Vous avez le droit de nous demander de corriger toute information que vous estimez inexacte. Vous avez également le droit de nous demander de compléter les informations que vous estimez incomplètes.
• Droit à l’effacement – Vous avez le droit de nous demander d’effacer vos données à caractère personnel, sous certaines conditions.
• Le droit de restreindre le traitement – Vous avez le droit de nous demander de restreindre le traitement de vos données à caractère personnel, sous certaines conditions.
• Le droit de s’opposer au traitement – Vous avez le droit de vous opposer au traitement de vos données personnelles, sous certaines conditions.
• Droit à la portabilité des données – Vous avez le droit de nous demander de transférer les données que nous avons collectées à une autre organisation ou directement à vous, sous certaines conditions.
• Si vous faites une demande, nous avons un mois pour vous répondre. Si vous souhaitez exercer l’un de ces droits, veuillez nous contacter.

Divisibilité et affectation

Si l’une des dispositions du présent contrat est invalide, nulle ou inapplicable, cela n’affecte pas la validité ou l’applicabilité des autres dispositions. SIP a le droit de céder à tout moment à un tiers ses droits et/ou obligations découlant du présent contrat.

Droit applicable et for juridique

Le présent accord sera à tous égards régi et interprété conformément au droit legal de la UAE (à l’exclusion des règles de conflit de lois), et le lieu de juridiction exclusif pour tous les litiges découlant du présent accord ou en rapport avec celui-ci (y compris tout litige concernant son existence, sa validité ou sa résiliation) sera Dubai, UAE.
